These Website Terms and Conditions ("Terms") govern access to and use of https://cdahive.com and any related online forms, content, and features operated by The Hive CDA, LLC ("The Hive," "we," "us," or "our"). By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website.
1. Website Purpose
The website provides general information about The Hive, including supervised drop-off play, preschool programming, memberships, hour packs, tours, events, birthday parties, and related offerings. Website content is provided for general informational and transactional purposes and may be changed at any time.
2. Separate Service Agreements Apply
These Terms govern the website. Participation in The Hive's programs or use of its facility may require separate documents, including an enrollment agreement, membership agreement, payment authorization, liability waiver, release, health or immunization forms, photo/video consent, birthday-party agreement, and facility policies.
Those separately accepted documents govern the applicable service. If these website Terms conflict with a signed or electronically accepted service agreement, the service agreement controls for that service. Displaying availability or accepting an inquiry does not guarantee enrollment, admission, a reservation, or continued participation.
3. Eligibility and Authority
The website and online account features are intended for adults. You represent that you are at least 18 years old and legally able to agree to these Terms. If you submit information or accept an agreement concerning a child, you represent that you are the child's parent or legal guardian, or that you otherwise have legal authority to do so.
Children should not create accounts or submit information directly through the public website.
4. Accurate Information and Accounts
You agree to provide current, complete, and accurate information and to promptly update information that changes, including contact details, authorized pickup persons, health and allergy information, and emergency instructions. You are responsible for maintaining the confidentiality of login credentials and for activity under your account. Notify The Hive promptly if you suspect unauthorized access.
We may refuse, suspend, or terminate website or account access if information is false, incomplete, misleading, unauthorized, or used in violation of these Terms or applicable law.
5. Playground and Other Third-Party Services
The Hive uses third-party providers to support portions of its operations. Playground may provide registration, family accounts, attendance, paperwork, billing, messaging, app features, and other services. Payment processing may be provided by Stripe or another processor. Your use of those services may also be subject to the provider's own terms and privacy policy.
The Hive does not control third-party platforms and is not responsible for their independent acts, omissions, availability, security, content, or policies, except to the extent responsibility cannot legally be excluded.
6. Prices, Payments, and Billing
Prices, deposits, fees, and availability shown on the website are subject to change unless otherwise stated in a separately accepted agreement. You authorize The Hive and its payment providers to charge the payment method you provide for purchases, deposits, recurring fees, or other authorized amounts.
You are responsible for providing valid payment information and for any taxes or processing fees disclosed before purchase. Recurring memberships, declined payments, cancellation deadlines, refunds, expiration dates, upgrades, downgrades, and other program-specific billing terms are governed by the applicable membership, enrollment, booking, or party agreement.
If a website price or description contains an obvious error, The Hive may correct the error and cancel or adjust the affected transaction, subject to applicable law. If payment has already been collected for a canceled transaction, the applicable amount will be refunded.
7. Electronic Communications and Signatures
By providing contact information, you agree that The Hive may communicate with you electronically regarding inquiries, accounts, enrollment, attendance, safety, schedule changes, transactions, billing, and services. Communications may occur by email, text message, telephone, or through Playground's parent application.
Where permitted by law, electronic acceptance, checkboxes, typed signatures, and electronic signatures have the same effect as handwritten signatures. Promotional email and text communications are addressed in our Privacy Policy and any consent language presented when you sign up.
8. Acceptable Use
You may not:
use the website for unlawful, fraudulent, abusive, or harmful purposes;
impersonate another person or misrepresent your authority concerning a child;
attempt to access another family's information or any restricted system;
interfere with website operation, security, or availability;
introduce malware, automated scraping tools, or harmful code;
copy, republish, sell, or commercially exploit website content without written permission; or
use website information to harass staff, families, children, or other persons.
We may restrict or block access when reasonably necessary to protect the website, The Hive, children, families, staff, or third parties.
9. Intellectual Property
The website and its text, design, graphics, logos, photographs, videos, downloads, and other content are owned by or licensed to The Hive and are protected by applicable intellectual-property laws. You may view and print website materials for personal, noncommercial use related to evaluating or using The Hive's services. No other rights are granted without prior written permission.
If a photo, testimonial, or other material belongs to a third party, it remains subject to the rights and permissions applicable to that material.
10. Informational Content and Renderings
Website descriptions, schedules, room layouts, photographs, illustrations, and renderings are provided to help families understand planned or current offerings. Renderings and plans are illustrative and may differ from the completed facility, furnishings, equipment, activities, or final design. Programs, hours, staffing, capacity, amenities, and availability may change based on operations, licensing, safety, demand, or other circumstances.
11. Privacy
Our collection and use of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference. By using the website, you acknowledge that you have reviewed the Privacy Policy.
12. Third-Party Links
The website may contain links to third-party websites or services. Links are provided for convenience and do not necessarily constitute endorsement. The Hive is not responsible for third-party content, products, services, terms, or privacy practices.
13. Website Availability and Disclaimer
We strive to keep website information useful and accurate, but we do not promise that the website will always be available, uninterrupted, secure, complete, current, or error-free. To the fullest extent permitted by law, the website and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied.
Nothing on the website is medical, legal, or professional advice. Families remain responsible for providing accurate information, reviewing applicable agreements, and determining whether a program is appropriate for their child.
14. Limitation of Liability
To the fullest extent permitted by law, The Hive and its owners, managers, employees, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of or inability to use the website or a third-party platform.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. Liability associated with participation in The Hive's programs or presence at the facility is addressed in the applicable waiver and service agreements, not solely by these website Terms.
15. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless The Hive and its owners, managers, employees, and agents from third-party claims, losses, liabilities, damages, and reasonable expenses arising from your unlawful use of the website, your violation of these Terms, your infringement of another person's rights, or information you submit without authority.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles. Unless a different process is required by a separately signed agreement or applicable law, any legal action concerning these website Terms must be brought in a court of competent jurisdiction located in Kootenai County, Idaho.
17. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted with a revised effective date. Changes apply prospectively when posted unless another date is stated. Your continued use of the website after an update constitutes acceptance of the updated Terms.
18. General Provisions
If a provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our written consent. These Terms, together with the Privacy Policy and any applicable separate service agreement, constitute the relevant agreement between you and The Hive concerning the subject matter they cover.
